Los 28 aprueban aumentar los controles sobre la elaboración de índices de referencia como Euríbor

Los países de la UE han alcanzado este viernes un acuerdo político, pendiente de negociar con la Eurocámara, sobre un reglamento cuyo objetivo es aumentar los controles sobre la elaboración de índices de referencia -como el Líbor o el Euríbor, que se usan para calcular el tipo de interés de las hipotecas– con el objetivo de aumentar la transparencia y evitar su manipulación.

"El reglamento garantizará que los índices de referencia sean sólidos, fiables y representativos", se ha felicitado el comisario de servicios financieros, Jonathan Hill, en un comunicado, en el que ha pedido que se aceleren las negociaciones con el Parlamento. Bruselas espera un acuerdo definitivo de aquí al verano.

La nueva norma es una respuesta a los recientes escándalos de adulteración del Líbor o del Euríbor por parte de los grandes bancos. Bruselas ya ha impuesto multas récord a un gran número de entidades internacionales y europeas -como Deutsche Bank, Royal Bank of Scotland, Société Général, JPMorgan o Citigroup- por participar en cárteles para manipular índices de referencia. Barclays y UBS también estaban pero se libraron de la sanción por ser los primeros delatores. Otras investigaciones contra Crédit Agricole o HSBC continúan abiertas.

De acuerdo con el nuevo reglamento, la elaboración de índices de referencia se convertirá en una actividad regulada y sometida a supervisión con el fin de garantizar su fiabilidad. Los administradores de estos índices deberán pedir autorización y estarán sujetos a la supervisión de las autoridades competentes del país donde estén localizados.

La Autoridad Europea de Valores y Mercados (ESMA) se encargará de coordinar la supervisión. Finalmente, se ha renunciado a convertir a la ESMA en supervisor único de los índices de referencia, lo que habría supuesto por ejemplo arrebatar a Reino Unido el control sobre el Líbor. No obstante, cuando un índice se considera de especial importancia a nivel europeo, la supervisión correrá a cargo de un colegio de supervisores nacionales.

El administrador de cada índice deberá elaborar un código de conducta que especifique claramente las obligaciones y las responsabilidades de los que contribuyen a elaborarlo, incluyendo los requisitos en materia de gestión de conflictos de intereses. El reglamento pide usar de forma sistemática cifras basadas en transacciones realizadas, en lugar de estimaciones, para ser más sólidos, aunque permite recurrir a estimaciones cuando no haya alternativas.

La norma no cubre sólo los índices de referencia de tipos de interés como el Líbor o el Euríbor, sino también los que se aplican a materias primas, energía o derivados de divisas, así como los que se utilizan para medir la rentabilidad de fondos de inversión. Los bancos centrales quedan excluidos porque ya tienen sus propios sistemas de control.

The member States of the EU reached political agreement on Friday, pending negotiation within the Euro Parliament, on a law whose objective is to increase the controls over benchmark indexes, such as the Libor or Euribor, which are used to calculate interest rates on mortgages, with the objective of increasing transparency and to make sure they are not rigged.

“The law will guarantee that benchmark indexes are solid, reliable and representative,” the Financial Services commissioner Jonathan Hill was pleased to announce in a press statement, during which he made a plea to speed up negotiations with the Parliament. Brussels is looking to make a final deal between now and this summer.

The new law comes in response to the recent Libor and Euribor rigging scandals involving big banks. Brussels has already imposed record fines on a large number of European and International financial entities -such as Deutsche Bank, Royal Bank of Scotland, Société Général, JPMorgan or Citigroup- because they were participating in cartels that were manipulating these benchmark indexes. Barclays and UBS were also on the list of those sanctioned but got off scot-free for being the first to squeal. Other investigations into Crédit Agricole or HSBC are still ongoing.

According to the new law, the creation of the benchmark indexes will be converted into a regulated activity and with be submitted to supervision in order to guarantee their reliability. The administrators of the indexes will have to gain authorization and will be subject to supervision of the competent authorities in the countries where there are based.

The European Securities Market Authority (ESMA) will be in charge of coordinating the supervision. Finally, it was recommended that the ESMA become the single supervisor over the benchmark indexes, which would mean taking the control of the Libor away from the United Kingdom, for example. However, when an index is considered to be especially important on a European level, its supervision will be controlled by a group of national supervisors.

The administrator of each index will have to create a code of conduct that clearly specifies the obligations and responsibilities that would contribute to the index´s creating, including those that deal with the management of conflicts of interest. The law urges to use data systematically that´s based on real transactions, instead of estimations, in order to be more sturdy although it allows for estimations when there are no other alternatives.

The rules don´t just cover benchmark indexes for interest rates such as Libor or Euribor but they are also applied to raw materials, energy or currency derivatives, as well as being used to measure the profitability of investment funds. central banks are excluded from this because they already have their own control systems.
