Comienza el plazo para solicitar y confirmar el borrador del IRPF

Este martes, 2 de abril, comienza el plazo para solicitar y confirmar el borrador del IRPF de 2012, que concluye el próximo 1 de julio, coincidiendo con el final de la Campaña de la Renta de este año, según el calendario de la Agencia Tributaria.

Así, desde este martes los contribuyentes que lo deseen pueden obtener el borrador y los datos fiscales de 2012 a través de la web de la Agencia Tributaria sin esperar a recibirlos por correo ordinario y, ese mismo día, si están de acuerdo con el resultado, pueden proceder a confirmarlo. Si la declaración sale a devolver, y se decide domiciliar el pago, el plazo para confirmarlo no concluye el 1 de julio, sino el 26 de junio.

Como novedad de este año, la Agencia Tributaria enviará el borrador a un número mayor de contribuyentes que hasta ahora no podían confirmarlo porque no cumplían las exigencias establecidas en la normativa, según una orden del Ministerio de Hacienda.

En concreto, este año podrán confirmar el borrador aquellos contribuyentes que reciban cualquier tipo de subvención, siempre y cuando no esté relacionada con actividades económicas, de tal manera, que quedan incluidos, por ejemplo, los perceptores de la renta básica de emancipación.

Del mismo modo, los contribuyentes que obtengan pérdidas patrimoniales derivadas de la transmisión o el reembolso de acciones o participaciones en instituciones de inversión colectiva también podrán confirmar el borrador. Hasta ahora sólo podían hacerlo si obtenían ganancias patrimoniales, pero no pérdidas.

Asimismo, los contribuyentes que declaren imputación de rentas inmobiliarias podrán confirmar el borrador si estos inmuebles no superan los ocho como máximo, frente al límite de dos viviendas que había anteriormente, exceptuando la vivienda habitual, un trastero y dos garajes.

También como novedad, se ha incluido a los declarantes que obtengan rendimientos de capital mobiliario e inmobiliario a través de entidades de régimen de atribución de rentas, cuando estos hayan sido atribuidos a los socios, herederos, comuneros o partícipes.

A todos ellos, se unen los colectivos que ya podían recibir y confirmar el borrador: los contribuyentes que sólo tengan rendimientos del trabajo, rendimientos del capital mobiliario con retención o ingreso a cuenta o letras del tesoro.

La Agencia Tributaria indica que este «mayor grado de flexibilidad» permite extender progresivamente el borrador a un mayor número de contribuyentes sin necesidad de proceder para ello a continuas modificaciones de la norma legal que regula el IRPF.

Se adelanta una semana el borrador y la campaña de renta
Otra de las
novedades es que este año la Agencia Tributaria ha adelantado una semana la petición y confirmación del borrador y de los datos fiscales
con respecto a la campaña anterior, cuando el plazo se abrió el 10 de abril.

En la misma línea, el organismo también ha adelantado una semana la Campaña de la Renta para las declaraciones que se presenten por Internet, que podrán presentarse a partir del 24 de abril, frente al plazo oficial que comienza el 6 de mayo y concluye el 1 de julio.

Aunque el borrador se podrá obtener y confirmar por vía telemática, a través de la sede electrónica de la Agencia Tributaria en Internet (www.agenciatributaria.gob.es), Hacienda enviará por correo ordinario el borrador los contribuyentes que no hayan recurrido a esta vía a partir del 6 de mayo, el día que arranca oficialmente la Campaña de Renta.

Quiénes tienen que declarar
En cuanto a los obligados a declarar, se mantiene en 22.000 euros los rendimientos íntegros de los contribuyentes que no están obligados a presentar la declaración de la renta cuando procedan de un sólo pagador (si tienen más de un pagador, la suma de las cantidades percibidas del segundo y restantes no puede superar los 1.500 euros), y en 11.200 euros la renta máxima anual que exime de esta obligación a los contribuyentes que tienen más de un pagador y siempre que la suma del segundo o de los restantes pagadores sea superior a 1.500 euros.

Sí están obligados a declarar aquellos contribuyentes que aún teniendo rentas del trabajo inferiores a los 22.000 euros anuales, se hayan aplicado deducciones por inversión en vivienda, por cuenta ahorroempresa, por doble imposición internacional, así como reducciones en la base imponible por aportaciones a planes de pensiones, a mutualidades de previsión social, a planes de previsión asegurados o a patrimonios protegidos de las personas con discapacidad.

On Tuesday, the 2nd of April, the time frame begins to request and confirm the personal income tax draft forms for 2012 and ends on the 1st of July, coinciding with the end of this year´s Income Tax Declaration Campaign, according to the Tax Agency´s calendar.

Therefore, starting on Tuesday, taxpayers who wish to do so can obtain online their tax draft forms and fiscal data for 2012 from their Tax Agency (Internal Revenue Service/Office) without having to wait to receive them by mail and, if they agree with their results, can confirm their tax statement on the same day. If they are to receive a tax return, and decide to receive it automatically in their bank account, the time frame to confirm their statement will not end on July 1st, but on July 26th.

As a novelty this year, the Tax Agency will send the forms to a larger number of taxpayers that, up until now, couldn´t confirm their statement because didn´t meet the established requirements of the rule, the Ministry of Finance stated in mandate.

Specifically, those taxpayers that receive any kind of subsidy will be able to confirm their statement provided that it´s not related to economic activities so that, for example,
those who receive the Basic Emancipation Income supplement are now included.

Similarly, taxpayers that have had losses on their patrimony derived from the transfer or redemption of stocks or shares in collective investment institutions will also be able to confirm their results. Up till now, only those who had obtained patrimonial earnings could do this, not with losses.

Furthermore, taxpayers who declare income attributed from real estate will be able to confirm their draft if the number of properties is not more than eight, compared to the previous limit of two homes, excluding the main residence, a storage room and two garages.

Another novelty is that for those who obtain income from capital gains or property investment though income attribution organisations must file tax returns if they have been attributed to partners, heirs or associates.

These are added to the groups that can already receive and confirm their draft forms: taxpayers that only have earnings from employment, taxed or deposited capital gains or Treasury bills.

The Tax Agency has indicated that this “greater degree of flexibility” allows for the progressive extension of the draft to a larger number of taxpayers without needing to resort to continual modifications in the legal framework that regulates personal income taxes.

The draft forms and tax season open one week earlier
Another nuance is that this year the Tax Agency has moved forward the date to request and confirm the tax draft forms and fiscal information by one week, compared to the previous tax season which opened on April 10th.

Along these same lines, the agency has also moved forward the tax season for declarations presented online, which now are presentable starting on April 24th, compared to the official time frame that starts on May 6th and ends on July 1st.

Even though the draft forms can be obtained and confirmed online on the Tax Agency´s web page (www.agenciatributaria.gob.es), starting on May 6th, the day the tax season officially starts, the Ministry of Finance will send the draft forms by ordinary mail to taxpayers who haven´t made an online request.

Who has to file a tax return?
For those who must file a tax return, the maximum earnings amount of 22,000 euros is maintained for taxpayers that are not obligated to declare their income when this amount is coming from only one employer (if a person has more than one employer, the sum of the additional amounts earned from the second, third, etc. employer cannot be higher than 1,500 euros) while the maximum earnings amount of 11,200 euros is maintained for exempted taxpayers that receive their income from more than one employer provided that the income from the second, third, etc. employers is over 1,500 euros.

Those taxpayers earning less than 22,000 euros annually still must file a return if they have declared deductions for home investments, for having a company-savings account, for international double taxation, as well as having reductions in their tax base for contributions to pension plans, to mutual social security entities (co-operatives) or to protected assets (patrimony) of dependent persons.
