El Supremo no celebrará el Pleno sobre preferentes

La Sala de lo Civil del Tribunal Supremo no celebrará finalmente el Pleno que tenía previsto para el próximo jueves, día 9 de mayo, para tratar por primera vez sobre el tema de las participaciones preferentes después que Santander haya decidido retirar su recurso, informaron a Europa Press en fuentes jurídicas.

En concreto, el Supremo tenía previsto estudiar un recurso extraordinario por infracción procesal y un recurso de casación presentados por el Santander contra la decisión de La Audiencia Provincial de Mallorca de resolver a favor de un matrimonio que adquirió este producto financiero.

Además, uno de los magistrados de la Sala Primera del Tribunal Supremo, Sebastián Sastre Papiol, había solicitado su abstención del Pleno debido a su pasado en el sector bancario, tras haber sido asesor jurídico de `La Caixa´.

La Sala presidida por Juan Antonio Xiol había calificado la reunión del Pleno de «trascendente» y había anunciado que la doctrina que sentara el tribunal para resolver este pleito se consideraría que creaba jurisprudencia sin tener que esperar a que recayera «otra sobre el mismo tema».

El asunto se había llevado al Pleno de la Sala Primera ya que se consideraba que se refería a un tema «de especial sensibilidad» en los momentos actuales, que necesitaba una respuesta judicial que unifica «la interpretación jurídica que sobre esta cuestión efectúan los juzgados de primera instancia y las audiencias provinciales».

El pleito se había iniciado mediante la demanda de un matrimonio contra el Santander en la que se pedía al juez que declarase que la venta de varios títulos del banco (participaciones preferentes) se hizo ocultando a los compradores el riesgo financiero que comportaba la operación o sin informarles del riesgo.

El juzgado de Primera Instancia de Mahón (Menorca) estimó la demanda y contra esta sentencia el Santander interpuso recurso de apelación que fue desestimado por la Audiencia Provincial de Palma de Mallorca.

In the end, the Civil Chamber of the (Spanish) Supreme Court will not hold a plenary session it had set for Thursday May 9th to look into the topic of the preferred stocks for the first time after Santander (bank) decided to withdraw its appeal, according to judicial sources of Europa Press.

Moreover, the Supreme Court was set to look into an unusual procedural infraction and an appeal presented by Santander against the verdict of Majorca´s Provincial Court that found in favour of a couple who had acquired this financial product.

Also, one of the judges in the First Chamber of the Supreme Court, Sebastián Sastre Papiol, had requested to be abstained from the plenary because of his past in the banking sector as a legal advisor to `La Caixa´ (bank).

The chamber, presided over by Juan Antonio Xiol, had called the plenary “of great importance” and the court´s decision on resolving the lawsuit would be considered as jurisprudence without having to wait for “another decision on the same area” to be put forward.

The case was being tried in the plenary of the First Chamber since it´s considered that it deals with an “especially sensitive” topic at the moment which needed a judicial ruling that unifies “the legal interpretation over which lower court judges and provincial courts can act.”

The lawsuit had started because of a married couple who, in suing Santander, asked the judge to rule that the sale of several types of bank shares (preferred stock) was done while concealing the financial risks involved in the operation from buyers and without informing them of the risks.

The lower court of Port Mahon (Minorca) considered the suit and Santander put in an appeal against the sentence which was not upheld by the Majorca´s Provincial Court in Palma.
